شرط زیاندیده و مسئولیت مشترک در رویه قضایی دیوان اروپایی حقوق بشر

چکیده
مطالعه حاضر به بررسی انتقادی تأثیر متقابل شرط «زیان‌دیده» موضوع ماده ۳۴ کنوانسیون اروپایی حقوق بشر و مفهوم مسئولیت مشترک در رویه قضایی دیوان اروپایی حقوق بشر پرداخته است. پرسش اصلی این است که تفسیر دیوان از شرط مزبور چگونه بر رسیدگی به پرونده‌های دارای مسئولیت مشترک به‌ویژه در مواردی که چندین بازیگر بین‌المللی در نقض نظام‌یافته یا غیرمستقیم حقوق مشارکت دارند، تأثیر می‌گذارد. این پژوهش با روش تحقیق حقوقی نظری و با تکیه بر تحلیل رویه قضایی، بررسی تطبیقی و ارزیابی انتقادی اصلاحات نهادی سامان یافته است. یافته‌ها نشان داد که پایبندی سختگیرانه دیوان به شرط زیان‌دیده و اصرار بر وجود «رابطه علّی مستقیم» میان اقدام دولت و آسیب وارده، هرچند از طرح دعاوی انتزاعی جلوگیری می‌کند، اما در وضعیت‌های مسئولیت مشترک به‌ویژه در پرونده‌های مرتبط با اقدامات اتحادیه اروپا به تضعیف پاسخگویی و ایجاد شکاف‌های عدالت رویه‌ای انجامیده است. در مقابل، سازوکار پاسخگویی مشترک پیش‌بینی‌شده در پیش‌نویس توافقنامه الحاق اتحادیه اروپا (۲۰۱۱) با نهادینه‌سازی مسئولیت مشترک، گامی مؤثر در جهت رفع این موانع تلقی می‌شود، هرچند کارآمدی کامل آن در گرو بازتعریف مفهوم «زیان‌دیده» و توسعه دکترین «مسئولیت ساختاری» در رویه قضایی دیوان است.
