آرای دادگاه اروپایی حقوق بشر و توسعه حق آزادی اجتماعات

چکیده

حق آزادی اجتماعات از مهم‌ترین حق‌های بشری و از مؤلفه‌های مشارکت سیاسی شهروندان برای دستیابی به حقوق اقتصادی، اجتماعی و فرهنگی دریک حاکمیت دموکراتیک است. بسیاری از فعالان حقوق بشر نقش دادگاه اروپایی حقوق بشر در توسعه تدریجی مفهوم و اعمال حق‌ها را مثبت ارزیابی می‌کنند. از این‌رو، پژوهشگران در این تحقیق درصدد برآمدند تا برای تأیید این نظر، آرای مختلف دادگاه اروپایی حقوق بشر در باب حق آزادی اجتماعات را مورد کندوکاو قرار دهند. لذا پرسش اصلی مطرح شده در این پژوهش این است که: «آرای دادگاه اروپایی حقوق بشر تا چه حد در توسعه‌ی حق آزادی اجتماعات تأثیرگذار بوده است؟» و در نتیجه‌گیری این فرضیه نویسندگان مورد تأکید قرار گرفته است که: « دادگاه اروپایی حقوق بشر در توسعه‌ی حق آزادی اجتماعات هرچند به صورت تدریجی و بطئی، نقش تأثیرگذاری ایفا می‌کند». دستاورد پژوهش با توجه به روح و فحوای نظریه "ایده برابر با رویکرد حقوقی و قضایی"، بر این ایده تمرکز کرده است که دستیابی به ارائه یک "تعریف مشترک" درباره حقوق بشر از الگو و مجرای آرای دادگاه اروپایی حقوق بشر امکان‌پذیر است و لذا دستیابی به آن را از رهگذر تفاسیر آرای دادگاه اروپایی حقوق بشر توصیه کرده است. این پژوهش از نوع توصیفی- تحلیلی است و از هدف توسعه‌ای پیروی می‌کند.
