Contrast between territorial integrity and human rights: legal evaluation of remedial secession’s theory

Abstract Five thousand types of minorities live in throughout the world. A glance at the map of the distribution of the minorities, clearly demonstrate that they were resided in the most critical regions in the world. One of the newest and the most serious events which was formed about issue of minorities in international law is their unilateral secession’s request; in other words, a separation which is not requested without the consent of the origin state. Kosovo secession from Serbia, request of Kurdistan’s secession from Iraq, request of Catalonia’s secession from Spain is considered as obvious practices of those events. What is the position of international law about these secessions? Are these secessions legitimate? Remedial secession’s theory tries to answer these questions. According to this theory, right on secession must be inevitably recognized where the end of gross breach of human rights isn’t met unless that part of territory was separated from the origin state. According to findings of this article it seems that this theory is not consistent with principles of international law.

Abstract One of the most Challenges of Iran Foreign Policy during of 2003-2015 was Iran nuclear Program. In these years the Governments of Seyed Mohamad Khatami and Mahmoud Ahmadinejad tried to solve the Problem of Iran Nuclear Case but this important issue only realized in Hasan Rouhani Government. The Main Question here is that what Factors did influence on decision making of Iran’s Officials and Acquiring of an international Agreement? Research Hypothesis is based on this argument that according to Rosenau’s Decision Making theory from five Factors have role in Decision Making of Countries; Individual, Society and International Factors had the most Effect on this Agreement. Research Findings show that characters of Hasan Rouhani, Demands of People to end Sanctions and Fulfillment their rights on nuclear peaceful program and world society welcome to Hasan Rouhani Presidency were the most important Factors in solving of Iran Nuclear Case. However, others factors (role and Bureaucratic) also had some effects. The research Methods is qualitative with emphasis on Explanatory method. The Data gathered by using of library and internet resources.

Abstract One of the important issues which deals simultaneously with the European Union (EU) enlargement policy and its common foreign and security policy, is EU's policy towards its neighbors. after EU enlargement. It is a crossroad of EU foreign, security, development and trade policies which aims at Europeanization and creating a ring of friends around its borders where good governance, political and economic stability, democratization and respect for human rights have been emphasized. The present article attempts to evaluate the effectiveness of this policy in reaching its targets. In this paper, Ukraine as one of the most important European countries where the policy is applied toward it, has been examined as a sample. Results show that in spite of some actions made by partners' countries, it was not, because of conflicting goals in partner countries, replicating accession, lack of sizeable incentives, lack of proper support of civil society, improper funding, as successful as it should be.

Abstract Public diplomacy is an idiom that has been noticed increasingly in last decades due to extension of internet and satellite news networks. This type of diplomacy be used related to influence, guidance and mobilization of public opinion for the aims of governmental and non-governmental agents. In this article, the author tried to give analytical answer to this question: in spite of being newest, why satellite network of Al-Jazeera has been more successful than western satellite networks in public policy and influence in public opinion in Arab world? The most rezones are: Independence and political taboo-breaking in news-image coverage, critical and analytical content, criticism of U.S.A dominance and it’s interventions in the region, pan-Arabism and pan-Islamism in discourse, defense of Palestinians rights, new and attractive techniques and structure in in news-image coverage and arrangement of political and analytical panels with emphasis on main issues of the middle east. The research method is secondary analysis of data and analytical-causal explanation. The most finding of this research is that: the Al-Jazeera network due to above- mentioned reasons has been successful in regional public diplomacy and influence in public opinion in middle east and north Africa, the peak point of that was the quickening role of this network in the mobilization and continuance of protests in the recent revolutions. So the role-and the position of this network must be notices by analysts.

Abstract Armenian lobby is one of most powerful ethnic lobbies in U.S. all branches of this lobby try to direct US foreign policy on their interests. Armenian National committee and Armenian Assembly are two famous organization of Armenian lobby. They try to achieve three obvious goals of Armenian lobby which are Recognition of Armenian Genocide by Ottoman Empire between 1915-1922, recognition of Independence or Autonomy of Nagorno Karabakh and obtaining financial assistance from U.S. Different elements form U.S Foreign policy and lobbies are one of these elements. Lobby under theory of group can be defined so this article must explain the role of groups in U.S policy. This article use Arthur Bentley theory as theoretical framework.

Abstract The fall of Saddam in 2003, Iraq's government and political system in general, and it changed the country in crisis Chndsalhay swallow, so that Shia power for the first time in the history of Iraq and the Kurdistan Regional Government's increased power. Kurdistan is the only region of Iraq before the invasion of ISIS (2014) In some regions, it has no impact of unsafe environment, their programs and try to serve as a bit actor, within the region and the world the. This research using descriptive and analytical approach and use of the Internet and library resources to answer the question: what effect developments in Iraq's Kurdish independence process? The findings show that over the past few years, certain developments that occurred in Iraq, among them the fall of Saddam in 2004, Iraq has a constitution in 2005 and the rise of Islamic power in 2014 noted. This is the main cause of Kurdish independence, but to speed up the process of Kurdish independence, and the changing role of facilitator to hold. In this regard, it is predicted that the orientation of the developments in this case, there will be an independent Kurdistan.
